Terms and Conditions
This web site ConfEngine.com including the mobile site, iOS & Android Smart-phone Apps (collectively referred as the 'Product') is owned and operated by ConfEngine Events Private Limited ('ConfEngine'), a company incorporated and existing in accordance with the laws of the Republic of India (together with its subsidiaries and other affiliates, 'us', 'We', 'our' or 'ConfEngine'). By accessing or using the Product you (the 'User') agree to be bound by the following terms and conditions:
1. Access to the Services
Subject to the terms and conditions of this Agreement, ConfEngine may offer you the service of creating a conference, adding proposals to an existing proposal, voting on a proposal and booking conference & workshop passes for conferences organised by ConfEngine and its partners, solely for User's own use, and not for the use or benefit of any third party.
ConfEngine reserves the right to change, suspend or discontinue the Services at any time, including the availability of any feature, or content. ConfEngine may also impose limits on certain features and services or restrict User's access to parts or all of the Services without notice or liability.
ConfEngine reserves the right, at its discretion, to modify this User Agreement at any time by posting a notice on our website, or by sending User a notice via email. User shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Services by User following such notification constitutes User's acceptance of the terms and conditions of this User Agreement as modified.
User certifies to ConfEngine that if User is an individual (i.e., not a corporation) User is at least 18 years of age. User also certifies that it is legally permitted to use the Services and access the Site, and takes full responsibility for the selection and use of the Services and access of the Site. This Agreement is void where prohibited by law, and the right to access the Site is revoked in such jurisdictions.
2. Right to Admission
At the conference, prior to admission, you will be request to present a valid photo ID to verify your identity. ConfEngine reserves the right to admission.
3. Online Sales
All ticket prices listed one our site is inclusive of all applicable taxes.
Once you successfully book your passes online, we'll send you a confirmation email with all the required details. Please note that we will handle all transactions electronically. We will not send any printed confirmations.
4. Cancellation/Refund Policy
We hope you understand that ConfEngine incurs various expenses prior to the conference. Hence it is necessary to impose the following cancellation policy:
- You can cancel your registration at any time up until 2 months before the actual conference. All cancellations must be received by email. Should you cancel, we will refund your registration fee, minus a 15% cancellation fee.
- No cancellations will be possible if the conference is less than 2 months away. You can, however, transfer your registration to another person. You will not receive any refunds in such cases. Email us to transfer your registration.
- No substitutions will be possible if the conference is less than 1 month away.
Conference or Workshop Cancellation
We hope it never happens, but there might be reasons outside our control, for which we may need to cancel or postpone one or more conferences or workshops. In such situation, we will notify you as far ahead of time as possible, and will refund the conference or workshop fee minus the cost incurred to-date. Refunds will be issued within 30 business days after the scheduled conclusion of the conference. Sorry, ConfEngine cannot, and does not, make exceptions to this policy.
We will not be liable for any loss or damages arising from such cancellation.
4. Conference and Workshop Content Changes
We will do our best to ensure conferences and workshops cover content as advertised. However, we may have to change scheduled dates, times or speakers if something unexpected happens. In such cases you will be notified about the change well in advance.
We will not be liable for any loss or damages arising from such changes.
User is responsible for all of its activity in connection with the Services and accessing the Site. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of Users right to Services or to access the Site. User may not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any user. Use of the Site or Services to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that which are deemed threatening or obscene, or engage in any kind of illegal activity is expressly prohibited.
7. Warranty Disclaimer
ConfEngine has no special relationship with or fiduciary duty to User. User acknowledges that ConfEngine has no control over, and no duty to take any action regarding: which users gain access to the Site; what Content User accesses via the Site; what effects the Content may have on User; how User may interpret or use the Content; or what actions User may take as a result of having been exposed to the Content. User releases ConfEngine from all liability for User having acquired or not acquired Content through the Site. THE SERVICES, CONTENT, SITE AND ANY SOFTWARE ARE PROVIDED ON AN 'AS IS' BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO USER. ConfEngine will not be liable for the privacy of email addresses, registration and identification information, communications, confidential or trade-secret information, or any other Content stored on ConfEngine' equipment, transmitted over networks accessed by the Site, or otherwise connected with User's use of the Services.
8. Registration and Security
As a condition to using certain Services, User may be required to register with ConfEngine and select a password. User shall provide ConfEngine with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of this Agreement, which may result in immediate termination of User's account. User may not (i) select or use another person's name with the intent to impersonate that person; or (ii) use ConfEngine id a name subject to any rights of a person other than User without appropriate authorization. ConfEngine reserves the right to refuse registration of, or cancel a ConfEngine' user in its discretion. User shall be responsible for maintaining the confidentiality of User's ConfEngine password.
User will indemnify and hold ConfEngine, its parents, subsidiaries, affiliates, officers and employees, harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of User's access to the Site, use of the Services, the violation of this Agreement by User, or the infringement by User, or any third party using the User's account, of any intellectual property or other right of any person or entity.
10. Limitation of Liability
IN NO EVENT SHALL ConfEngine BE LIABLE WITH RESPECT TO THE SITE OR THE SERVICES (I) FOR ANY AMOUNT IN THE AGGREGATE IN EXCESS OF THE FEES PAID BY USER THEREFOR; OR (II) FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO USER.
Either party may terminate the Services at any time by notifying the other party by any means. ConfEngine may also terminate or suspend any and all Services and access to the Site immediately, without prior notice or liability, if User breaches any of the terms or conditions of this Agreement. Any fees paid hereunder are non-refundable. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.
(a) Law, Jurisdiction and Venue
The performance, and interpretation of this Agreement will be governed by and construed in accordance with the laws of Bangalore, Karnataka, India, without regard to its conflicts of law provisions. The provisions of the UN Convention of Contracts for the International Sale of Goods shall not apply to this Agreement. The Parties shall submit to the exclusive jurisdiction and laws of Bangalore, Karnataka, India and irrevocably waive all venue objections.
User shall ensure that during the term of the Agreement, it shall have adequate insurance coverage to defray or cover its liabilities arising hereunder.
(c) Compliance with Children's Online Privacy Protection Act
Our services are targeted at software corporates. We do not target toward, and do not knowingly collect any personal information from users under 13 years of age.
(d) Audio/Video Policy
All the sessions will be video recorded by the conference organizers. No special permission will be taken from the participants. ConfEngine will own the complete rights to the recordings. Participants are not allowed to record (audio/video) the conference sessions without special permission from ConfEngine. Moreover, such recordings are only for personal use and cannot be placed online or transmitted to others without permission. Short audio and video clips may be used for blogging and press coverage of session. As a general guide, non-contiguous clips of one minute or less should be used.
