Terms and Conditions
ConfEngine.com, along with its mobile site, iOS and Android smartphone apps, collectively referred to here as the 'Product', is owned and operated by ConfEngine Events Private Limited ('ConfEngine') - A company incorporated and existing in accordance with the laws of the Republic of India. Together with its subsidiaries and other affiliates, the company is hereinafter referred to as 'Us', 'We', 'Our' or 'ConfEngine'.
By accessing or using the 'Product' as explained above, you, the 'User', agree to abide by the following terms and conditions:
1. Access to the Services
Subject to the terms and conditions of this agreement, ConfEngine may offer you various services such as creating a conference, adding proposals to an existing conference, voting on a proposal, and also booking conference and workshop passes for conferences organized by ConfEngine and its partners. These services are solely for the User's own use and not for the use or benefit of any third party.
ConfEngine reserves the right to change, suspend, or discontinue the services at any point in time, including the availability of any feature or content. ConfEngine may also impose limits on certain features and services, or restrict the User's access to part or all of the services without any notice or liability.
ConfEngine also reserves the right, at its discretion, to modify this User Agreement at any time, either by posting a notice on the website or by sending Users a notice via email. User(s) shall be responsible for reviewing and getting familiar with any such modifications, and use of the services by the User(s) following any such notifications constitutes the Users' acceptance of the terms and conditions of this User Agreement as modified.
The User certifies to ConfEngine that if she/he is an individual (i.e. not a corporation), then the user is at least 18 years of age. The User also certifies that she/he is legally permitted to access the website, use the services, and she/he also assumes full responsibility concerning the selection/use of the services and access of the site. This Agreement is void where prohibited by law, and the right to access the Site is revoked in such jurisdictions.
2. Right to Admission
ConfEngine reserves the right to admission to the conference. At the conference, prior to admission, you will be requested to present a valid photo ID in order to verify your identity.
3. Online Sales
Once you successfully book your passes online, we will send you a confirmation email with all the required details.
- Ticket prices listed on our site are inclusive of all applicable taxes
- We handle all transactions electronically and do not send any printed confirmations
4. Cancellation/Refund Policy
We trust you understand that ConfEngine incurs various expenses prior to the conference, making it necessary to impose the following cancellation/refund policy:
- You can cancel your registration at any time, until 1 month before the actual conference date. All cancellations must be received by email. Should you cancel, we will refund your registration fee, deducting a 15% cancellation fee. To process the refund, we would require your confirmation number, credit card number and the card's expiry date. Please ensure that the credit card details match the card you booked your ticket with.
- Cancellations are not possible if the conference is less than 1 month away. You can, however, transfer your registration to another person by visiting your ConfEngine account page. In case of transfer, you will not receive any refund.
- No substitutions/transfers will be possible if the conference is less than 3 days away.
Conference or workshop cancellation
Although we hope it never happens, there may be certain reasons beyond our control, for which, we may need to cancel or postpone one or more conferences or workshops. In such situations, we will notify you as far ahead of time as possible, and will refund the conference or workshop fees minus the costs incurred to-date. Refunds will be issued within 30 business days after the scheduled conclusion of the conference.
We apologize that ConfEngine cannot, and does not, make any exceptions to this policy.
Kindly note that we will not be liable for any losses or damages arising as a consequence of such cancellation(s).
5. Conference and Workshop Content Changes
We will do our best to ensure that the conferences and workshops cover the content as advertised. However, in certain rare cases, we may have to change the scheduled dates, times or speakers, in case something unexpected happens. In such cases, you will be notified about the change(s) well in advance.
We will not be liable for any losses or damages arising from such changes.
Users are responsible for all their activities in connection with accessing the ConfEngine website and using the services therein. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of the user's right to access the website or use the services. Users will not post or transmit, or cause posting or transmission of any communication/solicitation designed or intended to obtain password(s), account(s), or any other private information from any user. Using the website or services in a way that violates the security of any computer network; cracking passwords or security encryption codes; transferring or storing any illegal material, including that which is deemed threatening or obscene; or engaging in any kind of illegal activity - are all expressly prohibited.
7. Warranty Disclaimer
ConfEngine has no special relationship with or fiduciary duty to any User. Users acknowledge that ConfEngine neither has any control over nor any duty to take any action regarding which users gain access to the website, what content users access via the website, what effect(s) the content may have on the users, how users may interpret or use the content, or what action(s) users may take as a result of having been exposed to the content.
Further, all users release ConfEngine from all liability of the users having acquired or not having acquired content through the website. THE SERVICES, CONTENT, SITE AND ANY SOFTWARE, ARE PROVIDED ON AN 'AS IS' BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, HENCE, THE ABOVE LIMITATIONS MAY NOT APPLY TO THOSE USERS.
ConfEngine will also not be liable for the privacy of email addresses, registration and identification information, communications, confidential or trade-secret information, or any other content stored on ConfEngine's equipment, transmitted over networks, accessed by the website, or otherwise connected with the user's use of the services.
8. Registration and Security
As a condition to using certain services of ConfEngine, users may be required to register with ConfEngine and select a password. The user shall provide ConfEngine with accurate, true, complete, and updated registration information, and failure to do so shall constitute a breach of this Agreement, which may result in immediate termination of the user's account.
The user may not:
(i) Select/use another person's name with the intent of impersonation
(ii) Use a ConfEngine ID that is subject to any rights of a person other than the user without appropriate authorization
In both the above cases, ConfEngine reserves the right to refuse registration of, or even cancel/terminate a user's ConfEngine account as per its discretion.
Also, all users shall themselves be responsible for maintaining the confidentiality of their ConfEngine password.
Users must indemnify and hold ConfEngine, its parents, subsidiaries, affiliates, officers and employees, harmless, including all costs and attorney's fees, from any claim or demand made by any third party due to or arising out of the users' access to the website, use of the services therein, violation of this Agreement by the users, or infringement by the users, or any third party using the user's account, of any intellectual property or other right of any person or entity.
10. Limitation of Liability
IN NO EVENT / UNDER ANY CIRCUMSTANCES, SHALL ConfEngine BE LIABLE WITH RESPECT TO THE SITE OR SERVICES FOR:
(I) ANY AMOUNT IN THE AGGREGATE IN EXCESS OF THE FEES PAID BY A USER THEREFOR; OR,
(II) ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, HENCE, THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO THOSE USERS.
Either party may terminate the services at any time by notifying the other party by any means. ConfEngine may also terminate or suspend any and/or all services and access to the website immediately, without prior notice or liability, if any user breaches any of the terms or conditions of this Agreement - In case of which, any fees paid hereunder would be non-refundable. All provisions of this Agreement, which by their nature should survive termination, shall survive termination, including without limitation, ownership provisions, warranty disclaimers, and limitations of liability.
(a) Law, Jurisdiction and Venue
The interpretation and execution of this agreement will be governed by and construed in accordance with the laws of Bangalore city in the state of Karnataka, India, without regard to its conflicts of law provisions. The provisions of the UN Convention of Contracts for the International Sale of Goods shall not apply to this Agreement. The parties concerned shall submit to the exclusive jurisdiction and laws of Bengaluru, (Karnataka, India) and irrevocably waive all venue objections.
All users shall ensure that during the term of this agreement, they have adequate insurance coverage to defray or cover its liabilities arising hereunder.
(c) Compliance with Children's Online Privacy Protection Act
Our services are targeted at software corporates. We neither target nor knowingly collect any personal information from users aged below 13 years.
(d) Audio/Video Policy
All the sessions will be video recorded by the conference organizers, for which no special permission will be taken from the participants, and ConfEngine will own complete rights to all the recordings. Also, participants are not allowed to record (audio/video) conference sessions without special permission from ConfEngine. Moreover, such recordings are only for personal use and cannot be placed online or transmitted to others without permission.
Short audio and video clips may be used for blogging and/or press coverage of sessions. As a general rule, non-contiguous clips of one minute or less should be used. Please contact us if you need further guidance about longer clips.
